데이비드 흄은 <원시계약에 관하여>라는 논문에서 당시 영국 국민을 둘로 나누고 있었던 두개의 정당 즉, 토리당(왕당파)과 휘그당(의회파)의 이론들을 문제삼아 비판하고 있다.

이와는 반대로 로크의 사회계약설은 국가 정부는 인민의 최초의 동의(원시계약)로부터 발생했으며 그 동의는 현재까지 효력이 유지된다고 주장한다.
그들에 따르면 인간은 모두 평등하게 태어났기 때문에 군주나 정부에 대한 충성의무는 각자의 동의와 약속에 의하지 않는다면 부과될 수 없는 것이고, 더구나 이 약속도 군주(정부)가 자신을 잘 보호해주지 않는다면 충성의 의무는 소멸한다며 왕권에 대한 저항권을 주장하였다.

이에 흄은 사회계약론자들의 이러한 주장은 역사상의 사실과 어긋난다는 점을 지적한다. 정부의 기초가 되는 이 원시계약이 조상의 동의에 의해 자손들 끝대에 이르기까지 구속한다는 점은 제쳐두고서라도 세계 어느역사를 보더라도 국가의 최초의 수립이 인민들의 동의에 의해 수립된 역사는 없다는 것이다.

흄은 모든 새로운 국가(정부)의 수립이 그것의 명분을 왕권신수설에 의하든 사회계약론에 의하든 어떠한 미사여구로 꾸며대며 정당화시키려고 해봤자 결국은 기존 권력을 찬탈한 것일 뿐이라고 자신들의 권력을 위해 이론적 배경까지 작의적으로 만들어내는 두 입장을 모두 비판한다.
흄은 최고의 명예가 주어져야 하는 권력이란 신의 대행자나 사회계약으로 그 명분이 만들어지는 것이 아니라 법과 제도의 체계를 확립하여 인민의 평화와 행복과 자유를 확실하게 만들어주는 자에게서 비롯되는 것이며, 당파를 만들어내고 당파적인 대립을 격화시키는 것으로는 인민을 위한 정부를 만들어낼 수 없다고 주장한다.
당파적 대립을 격화시키는 자는 서로 도와야할 같은 나라 사람들 사이에서도 격렬한 적의를 만들어내기 때문이고, 그러한 갈등은 바른 이성이 아닌 편협적 편견으로 국정을 운영하게 됨으로 그 피해는 인민들이 고스란히 겪게 된다.
또한 국가의 최초의 수립이나 권력자가 바뀔때에는 그 속성이 인민들에게 익숙한 기존권력을 탈취하는데서 이루어지기 때문에 왕권신수설이나 사회계약론같은 허황된 명분으로 인민들의 복종을 갈구해봤자 오히려 적대감과 거부감만 느껴지게 된다고 하였다.
새로운 세력이 정당성을 확보하고 인민의 지지를 얻기 위한 유일한 방법은 오직 시간뿐이라며, 오직 시간만이 그들의 권위를 굳게 다지며 시간만이 인민들의 정신에 조금씩 작용함으로써 그 정신을 권위에 조화시켜 그 권위가 정당하고 합리적으로 여겨지도록 국가를 잘 다스리고 인민을 위해 노력해야 한다고 말한다.
인간의 마음을 어느 곳으로 향하게 이끄는 가장 큰 원인은 습관이다. 사람들의 생각이 어떤 대상으로 향하게 하기 위해서는 사람들이 그 대상에게 익숙해질 시간이 필요하다.
새로운 권력을 보여주려고 하는 자는 국민들이 그동안 오래도록 습관화 된 기존 권력의 모양새에서 벗어나 새로운 권력의 모양새에 익숙해질때까지 인내심있게 버텨내는 것이 필요하며, 새로운 권력의 행태가 실제로 사람들의 안녕과 생존에 유리한 이익을 가져다주게 된다면 정부에 대한 인민의 복종은 그제서야 비로서 얻어지게 되는 것이다.
시간과 습관은 인간의 정신에 권위를 각인시키는 가장 강력한 원천이다. 인민들이 어떤 정부에 오랫동안 복종해왔다면, 그들은 그 정부를 정당하다고 믿기 시작한다. 권위의 정당성은 원시적인 계약서에서 나오는 것이 아니라, 세대를 거쳐 쌓인 익숙함과 그 통치가 가져다주는 실제적인 이익에서 나온다.
