혹자는 눈을 가리지 않은 정의의 여신상에 대해서

첫째, 신이기 때문에 눈을 가리지 않아도 된다는것.
둘째, 눈을 가리게 되면 정작 자기 손안의 칼과 저울, 법전마저 볼수 없을것이라며 정의의 여신이라면 당연히 눈을 가리지 않는 것이 더 맞다는식으로 말한다.

그러나 기대와달리 그리스 로마 신화에서 그려지는 신들은 완벽하지 않고 실수도 하며, 인간처럼 희노애락의 감정을 가지고 있다.

어느 판사님이 우리나라 대법원의 눈을 안가린 여신상에 대해 절대자인 신의 판단은 절대 틀릴수 없기에 한낱 인간처럼 눈을 가릴 필요없다는 해석을 듣고 솔직히 어이가 없었다.

‘신이기 때문에 눈을 가릴 필요없다’는 해석에는 ‘절대자’라는 오만과 독선이 서려있는 해석이기 때문이다. 신이 설령 완벽한 판결을 내릴수 있다 한들 법원의 재판관들이 신과 같은 존재들로서 국민들에게 “나의 판결에 의심을 하다니 무엄하도다"할정도로 절대판결을 내려주는 존재들은 아니지 않는가?

오히려 그런 해석이 판사들로 하여금 선민의식이나 권위의식 독선과 오만을 갖게하는 것이 될 수 있다고 생각한다.

정의의 여신이 눈을 가린다는 것은 여신이 인간처럼 어리석어서가 아니라 정의의 여신마저도 눈을 가릴 만큼 조심성있고 신중하게 판결해야함을 상징적으로 표현한 것이라고 본다.

눈을 가리면 정작 봐야할 저울과 칼, 법전을 보지 못해서 안된다는것도 웃긴게, 정의라는 것은 정의의 여신이 자기손에 든 저울과 칼 법전을 보지 않아도 진실 그대로 판명 “되어야"하는 것이지, 정의의 여신이 어느쪽으로 기울여야 잘된 저울질일까, 어떻게 칼질해야 잘 썰린걸까, 어떤 법리로 구색맞춰야 맞을까하고 눈으로 보고나서 작의적으로 판명 “하는것"이 아니기 때문이다.

명색이 정의의 절대자인 “신"인데 판결내릴때 저울질, 칼질, 법전 뒤적거리며 눈치본다면 오히려 절대자로서 가오 떨어지는 모양새 아닌가? 신이 완벽하고 절대적이라면 저울, 칼, 법전 또한 들고 있을 필요도 없을텐데? 뭣하러 그런 인간의 판결 도구는 쥐고서 있는것인가? 눈을 가려야 할 필요도 없을 정도로 절대판결을 내릴수 있다면 저울 칼 법전도 필요없는거 아닌가? 완벽한 정의를 지닌 신의 절대성을 표현하고 싶었던거라면 눈가리개 뿐만 아니라 인간의 판결 도구인 저울, 칼, 법전도 다 없애고 순수하게 여신만 세워놔야지 않겠나?

신이기 때문에 당연히 눈을 가릴필요 없다는것은 법원의 권위가 신과 같다는 것으로 해석될 여지를 제공하는 것인데 도대체 누가 이런 해석으로 대법원의 권위주의를 옹호한건지 그 최초의 출처가 궁금하다. 유럽의 많은 나라들도 눈뜬 여신상을 추구한다고 의견을 덧붙이겠지만, 유럽의 많은 나라들이 그런 여신상을 추구하는 쪽으로 흘러간다고 그것이 옳은것이라고 말할수는 없는거다. 법원의 권세를 상징적으로 드높이려는 장치로 교묘하게 그렇게 만들어지는것일수도 있기 때문이다.

뭔가 상징적이고 기념비적인 동상을 만드는 이유는 그 동상을 통해 교훈을 얻을수 있는 바를 많은 사람들에게 전달하고 그속에 담긴 깊은 뜻을 오래도록 유지토록하고 싶기 때문이다.

대한민국 대법원의 여신은 눈가리개가 필요하지 않을정도로 얼마나 능력이 좋은가를 자랑질하려고 동상으로 박아둔것은 아니지 않는가?

더욱이 자기가 얼마나 잘난건지 으스대는 동상을 보면서 사람들이 과연 존경심이 들까?

정의의 여신 앞에서서 스스로를 성찰하게 하고 바른 정의를 향한 뜨거운 열의를 요동치게 할 수 있을까?

정의의 여신상은 그러기 위해서 만들어진것 아니었던가
